    Peloton Treadmill Injuries

May 5, 2021: Peloton has recalled roughly 125,000 treadmills after dozens of reports of adults, children, pets and objects getting pulled under the treadmill. Of the reported injuries, about 30 involve children. Injuries include serious abrasions, fractures and cuts. A young child recently died after getting pulled under the back of the treadmill.

The affected model number is TR01, also known as the Peloton Tread+. It was previously known as the Peloton Tread.

This recall is separate from another recall involving the Peloton Tread, which was recalled due to a potential for the console to detach and fall, posing an injury risk to users.

Legal Info – What to Know About Peloton Treadmill Lawsuits

    Product Defect Lawsuits

State law varies, but generally, any company which manufactures, distributes or sells a defective product can be held liable when the product causes injury. This is true whether it’s a large international company or a small retail company.

To prevail in a product injury lawsuit, an injured party has to prove that the product was manufactured defectively, designed defectively and/or failed to warn the average consumer about the risk of injury.

In the case of Peloton treadmills, the most probable claims would be that 1. the treadmills were defectively designed, or 2. failed to provide sufficient warnings about the risk of getting pulled under the treadmill.

Proving these claims will require the use of mechanical engineers and experts who will analyze the treadmill, functioning, any defects, warnings, instructions, etc., and provide an opinion about the treadmill’s design and warnings.

    What Claims Can You Make?

In a product injury lawsuit, the injured party can make financial compensation claims for medical bills, lost wages and pain and suffering. In severe injury cases or where the injury results in a permanent disability, the injured party can make claims for future expenses (medical bills, lost wages, etc.), as well as future pain and suffering.

    How are Attorneys’ Fees Paid?

Attorneys’ fees in these cases are paid from the proceeds of any settlement. If there is no settlement, the injured party owes nothing. The law firm assumes all the risk in that regard.

How to Win a Product Injury Case

Product injury cases often require an enormous investment during the course of litigation, especially when securing experts. Further, product injury cases can take years to litigate. Large companies fight tooth and nail to beat product injury cases. It’s crucial to be represented by a reputable law firm with experience in complex product injury cases. Experienced lawyers will obtain the right team of experts to present the best claims in your case.
